ANN’S MYROW DIARY W/C 9th June

ANN’S MYROW DIARY W/C 9th June

Sunday 9th The Norfolk County Council evidence ‘bundle’ has now been received by my advisor. I have a copy so now at least we are able to see just what NCC are basing their claim upon. So far, I can see no evidence which would bear any close scrutiny at a public enquiry. There is NO evidence of Adoption, dedication or maintenance. Monday 10th Public money should not be squandered because of the incompetence of Council employees who base their…

ANN’S MYROW DIARY W/C 2nd June

Monday 2nd Well I certainly have some interesting reading this week! All the ‘evidence’ on which the council intend to base their claim of a Byway Open to All Traffic through my garden. Tuesday 3rd A lot of photocopying! Five A4 files of it to be exact! Wednesday 4th There appears to be only one ‘sticking point’ with whether or not the council should quash their own order for a BOAT through my garden. WAS POCKTHORPE LANE ON THE LIST…

ANN’S MYROW DIARY W/C 26th MAY

Sunday 26th Trying to understand just why NCC are still getting it wrong. To explain. They cannot make an order if a route is…… 1.NOT on the definitive map AND 2. NOT on the List of Streets in 2006. I say that applies to my route. They say it doesn’t. Think of my Lane as part one and part two. Part one, the Lane, ends at End Cottage. Part two is the non existing ( and has never existed) part…

Post Script to Ann’s Diary wk/c 19th May

Excerpts from County Council emails. They speak for themselves!!! Subject:RE: Claimed highway Thank you for your email. I fear we may have reached an impasse and it is likely now that this matter will be tested through the courts. I understand that legal and other advisors have been appointed to act by some of the parties. It would therefore be inappropriate for me to deal with this matter through our corporate complaints process. My colleague James has conduct of the…

ANN’S MYROW DIARY W/C 19th MAY

Sunday 19th Well, as the Little Ditty might suggest, everyone seems to be living at the ‘whim’ of County Councils. It is thought provoking that those ‘claiming’ that they have a right over private property are the ones vested with the power to take just as long as they like to actually claim that right, even when the evidence suggests that the right has never existed in the first place. It is a sobering thought that the paraphernalia associated with…

ANN’S MYROW DIARY W/C 12th MAY

Sunday 12th Today started with the discussion ( by email) of the huge increase in claims of Restricted Byways. There is rather an anomaly here as Restricted Byways originally came about as a legal way of reclassifying RUPP’s ( Roads Used as PublicPaths). The discussion has yet to come to a satisfactory conclusion as to if a modification order can solely claim a NEW Restricted Byway. Legislation might help! http://www.legislation.gov.uk/uksi/2006/1177/pdfs/uksi_20061177_en.pdf Here is the policy for the legislation which seems to…

ANN’S MYROW DIARY W/C 5th MAY

Sunday 5th Bank holiday, but, PROW discussion and research is ongoing and never ending. Today the subject is roads coloured ‘yellow’. A “plausible” case of why Yellow was used for “unimportant” roads /cul-de-sacs,  single lanes to farms…..in Somerset…..  [ancient Accommodation roads which were not maintainable at public expense…. and over which “public” [general] rights had to be acquired  – by way of 20 years’ unchallenged use. The MoT papers in Kew advise  Red,  Blue,  Green and Brown  –  importance in…

ANN’S MYROW DIARY W/C 28th APRIL

Sunday 28th. A very useful find if you are the victim of unlawful procedure by your County Council. They really do have to abide by the law when it comes to delegation of duty. Have a close look at exactly what Councils can or can’t do! https://www.legislation.gov.uk/uksi/2000/2853/contents/made In my own case Norfolk County Council refused my requests for their decision to go before committee. Monday 29th. Today’s ‘find’ was case law concerning the NERC Act 2006(Natural Environment and Rural Communities)…

Ann’s Myrow Diary W/C 21st April

Monday 22nd The ‘talk’ this week has been concerned with the delegation of powers used by councils. It appears that many abuse this power. ‘The regulations specifically prevent delegation in relation to section 53 http://www.legislation.gov.uk/uksi/2000/2853/schedule/1/made A Decision has to be made by “Elected members”….  and they can only “delegate”  when there is NO contention/conflict…… Norfolk County Council have a delegation policy. It states the following; Officers can only act within delegated powers and these are exercisable subject to: (a) strategies,…

Ann’s Myrow Diary W/C 15th April

Can you imagine two way traffic through this garden? Sunday 15th – Friday 20th Visiting Wales. One silver lining in joining together with rights of way colleagues is that you get to meet with many other interesting people from all walks of life and parts of the country. Saturday 21st Much email discussion concerning ‘delegated powers’ used by County Councils. Norfolk CC used those powers to deny my human rights to ‘be heard’. Legislation concerning ‘delegation’ and the policy document…
