This website is a voice for victims of unfair ‘Public Rights of Way’ disputes!

My name is Ann Scott and I am the victim of a Public Right of Way claim through my garden. Along with other friends who also suffer from this blight on their lives, we hope to help ourselves and others who find themselves alone in an unjust, unfair and archaic system. It will take us a while to get to grips with making a relevant and interesting web site but we are an enthusiastic bunch with much expertise between us….

Telegraph September 10th 2017 Essex County Council has spent a staggering £310,000 investigating claims for public footpaths over the last five years, and more than £40,000 defending their decisions when members of the public objected. Norfolk Public Rights of Way claimed by Dr L.David Ormerod MB BS MBA MSC FRCP FRCS DTM&H…..yes really…..

Mr Ormerod has also stated that he is the Rights of Way Officer for Swaffham but the present Swaffham Clerk didnt know that they had one. Anyway, Mr Ormerod has taken it upon himself to start claiming private land as a Public Right of Way or Restricted Byway. Land that is NOT ON THE DEFINITIVE MAP Unfortunately, due to the ludicrous Rights of Way system which allows completely bogus claims to actually be taken seriously, this will mean at least…

An Idea that won’t work! My Response to Norfolk Local Access Forum.

Have you heard of the 2026 deadline for using historical evidence to claim presently non existent Public Rights of Way? That’s another SEVEN years for claims to be registered and Access groups have already had the last few decades already. County Councils are about to break under the strain and the Public Rights of Way System is set to collapse because it is not fit for purpose. Here’s the quote from Norfolk Access Forum. “It was noted that Worcestershire Local…

You had better be rich if someone claims that there is a ‘lost’ footpath Through your garden!

You had better be rich if someone claims that there is a ‘lost’ footpath Through your garden!

The courts are littered with overturned results of Authorities and Inspectors. But rarely are these from home owners who are normal workers, a fire fighter, a farmers widow or a retired school teacher. They are from companies or well off individuals who can afford 6 figure fights, who can employ solicitors on hundreds per hour or barristers for thousands a day, who can employ specialist researchers or experts which is all out of reach of the average man or women…

ANN’S MYROW DIARY W/C 5th August

ANN’S MYROW DIARY W/C 5th August

Monday 5th Did you know that ANYONE can put in a claim for a right of way if they happen to find an old map ( say circa 1886 and 1930) and it has Footpath marked on it. It might be the footpath that in 1886 the local vicar used to get from his rectory to the church ( to save him from having to walk too far.) of course it now goes straight through someone’s living room ?( I…

ANN’S MYROW DIARY W/C 29th JULY

ANN’S MYROW DIARY W/C 29th JULY

Monday 29th I receive a reply from Lord Gardiner of Kimble (Parliamentary Under Secretary of State for Rural Affairs and Biosecurity). Lord Gardiner is the Minister responsible for rights of way policy! He explains, in his letter, that when the Deregulation Act 2015 is actually implemented, I will be able to apply to extinguish or divert a footpath or bridleway. He doesn’t mention what you do if there is a modification order for a BOAT through your garden! He doesn’t…

ANN’S MYROW DIARY W/C 21st JULY

ANN’S MYROW DIARY W/C 21st JULY

Monday 21st My thoughts today were on anonymity. It occurred to me that very often the names of ‘claimers’ of private property are withheld whereas the victims of the claim( householder/landowner are published anywhere and everywhere for public scrutiny. Vicious comments or unpleasant confrontations at the site of a ‘perceived’ but not proven right of way have to be suffered for any number of years. In the line of ‘bear baiting’ I have discovered. Tuesday 22nd “Bureaucrats are eating away at…

ANN’S MYROW DIARY W/C 14th July

Monday 15th NCC told my adviser that the Pockthorpe inquiry would be taking place within the next eleven months and to let them know if there were any dates that he couldn’t make! They haven’t even notified us! So I suppose we are expected to keep our lives ‘on hold’ indefinitely. After five years…..what’s another one anyway! Tuesday 16th Pockthorpe Lane is finally ‘on the agenda’ of the Parish Council. As ‘the horse has already bolted’ I will not be…

The Balance of Justice

The Balance of Justice

Where Public Rights of Way are concerned it is annoying and depressing that Individuals, who of course defend their own right to object to a claim on their private property, are usually the ones to suffer attack from all sides, seen as anti everything and labelled as vexatious trouble makers.  In contrast, those individuals and pressure groups proportedly fighting for people’s rights are respected and given honours. They celebrate ‘victories’ whilst promoting conflict. Why isn’t the plain truth of the…
