Momentum swings in favour of keeping PROW out of gardens!

Momentum swings in favour of keeping PROW out of gardens!

An Inspector confirms an order to divert a PROW out of a garden because it is intrusive and invades the privacy of the owner. This inspectors decision was challenged in court by the Open Spaces Society. Common sense triumphed and the decision was upheld. This decision is now very relevant in the current health crisis. The presence of walkers, riders and cyclists in the garden of a house or in a farmyard or other enclosed space exercising a public right of…

The difference is in the definition of a Right of Way and a public highway……..

The difference is in the definition of a Right of Way and a public highway……..

Enclosure Acts were limited to the parish and therefore the parishioners who needed to use them to reach allotments of land defined in the Act. What has been ignored is the “customary” way – and that it is a “favour” in a limited section of the public, such as the parishioners, a “favour” is a privilege which can be relinquished simply by non-use….. being a “privilege” allowed to those who have a special relationship with the landowner [such as a…

To lose one mile of footpath may be regarded as a misfortune. To lose 49,000 miles of footpaths looks like carelessness.😂

To lose one mile of footpath may be regarded as a misfortune. To lose 49,000 miles of footpaths looks like carelessness.😂

But that, according to the Ramblers, is the total length of footpaths missing from modern maps in England and Wales. Perhaps they haven’t worked out why so many roads and motorways are missing from Historic Maps.🤣

Ramblers have £11.9MILLION but ask for CROWD FUNDING! They use it to claim ‘lost footpaths’ through gardens, homes & farmyards.

Ramblers have £11.9MILLION but ask for CROWD FUNDING! They use it to claim ‘lost footpaths’ through gardens, homes & farmyards.

Quote from the Ramblers; “Overall, the Ramblers remain in a strong financial position resulting from good management of our funds, with total net assets of £11.3m (2018: £11.9m).” The Ramblers benefit from 32% of proceeds from The Postcode Lottery!COTSWOLD OUTDOOR supported the Lost footpaths crowd funding by £10,000! This charitable money is helping to claim public rights of way through ludicrous places such as small gardens, private homes, working farms and farmyards. THE COST OF CLAIMS ACTUALLY FALLS ON THE…

The finding of ‘lost paths’ by the Ramblers is a propaganda campaign.

The finding of ‘lost paths’ by the Ramblers is a propaganda campaign.

The inference is that the paths ‘found’ are already Public Highways. They are not.The paths ‘found’ are historic tracks based on maps circa 1886. The Ramblers must now search for any evidence that they were ever ‘public’County councils are obliged to investigate ‘reasonable’ allegations. Costs are from the public purse. All councils already have a huge backlog of allegations/applications to investigate. This can take up to 30 years.NO account is taken of the route of the paths. They can go through…

There is no such thing as a ‘Lost Path’ never mind 49,000 of them!

There is no such thing as a ‘Lost Path’ never mind 49,000 of them!

The result of the Ramblers so called ‘Lost Paths’ campaign is now revealed, in typical vitriolic manner, but even I was sickened and shocked by the staggering number of 49,000 miles they have announced Adding insult to injury the Ramblers are asking for the help of people who have scant knowledge of PROW and the complex process involved. The law is so ludicrous that it allows paths to  be claimed through someones living room, and I suspect that that some…

Lockdown and Public Footpaths through Private Gardens.

Lockdown and Public Footpaths through Private Gardens.

I have been looking for guidance concerning public footpaths which go through private gardens. During the last lockdown there were some very unsavoury disputes caused by the lack of clear guidance and the refusal of government to protect vulnerable people from public wandering at will through their private gardens and farmyards. Happily, I have at least read the following; Outdoor public places include: parks, beaches, countryside, public gardens (whether or not you pay to enter them), allotments playgrounds You cannot…

Cowards of the ‘Anonymous’ Complaint.

Cowards of the ‘Anonymous’ Complaint.

It’s really not nice when an anonymous member of the public makes a complaint about you. It’s even worse when you know that their complaint stems from perhaps a personal dislike, a jealousy or just a sheer desire to get you into trouble. I suffered yet another of these ‘made up’ anonymous complaints again last week. Fortunately I am of an age that affords me a very thick skin concerning these matters and I am happily able to ignore it…

A FOOTPATH PAVED WITH (YOUR) GOLD

A FOOTPATH PAVED WITH (YOUR) GOLD

By:BrianPain&David Rottenborough This is definitely worth a read. The article is from The Faversham Eye and can also be read by clicking on the link above. How a small clique of Parish councillors can manipulate the law to finance their pipe dream with charity and taxpayer’s money. Plan of the footpath routes: the closed path is in red and the alternative route in blue. The dashed black lines are public footpaths It was only going to cost £4,500. So it…

Ramblers Rule! They can walk in groups of thirty. Why?

Ramblers Rule! They can walk in groups of thirty. Why?

so it’s one rule for everyone else and another for the Ramblers! Of course, I shouldn’t be surprised, it’s always the same for this untouchable organisation. It never fails to amaze me how they wield this Incredible power, when even government are frightened to upset them! They are even classed as a charity and receive funds from the postcode lottery. I wonder how many of the public realise how rich an organisation they are and yet they are allowed to…
